12 May, 04: The Additional District Judges' Court today released all the five accused polling party officials who were arrested yesterday following a complaint by the election observer. In an
unprecedented move the Public Prosecutors were found putting up the case themselves along with the Case Diary prepared by the police with extra fast effort. The polling officers along with the presiding officer of Churulia Sailabala Balika Vidyalaya booth in Jamuria, Asansol were arrested on charges of indulging in bogus voting.
The case was moved to the ADJ's court today. The lawyers were quite surprised that the police served the CD that was prepared today itself though usually the police takes weeks to table a CD in any case. The SDJM, Asansol had refused bail to the accused presiding and polling officials yesterday. They were accused under sections 132, 134 and 135 (A) of the Representation of Peoples Act 1951. The sections suggest a minimum imprisonment of 5 years. They were accused following reports filed by Ms Swarnamala rawala, the central election observer who found a number of discrepancies while visiting the booth NO: 4 at the Churulia school in Jamuria. The observer had found that a false voter had exercised vote producing substitute identification though the bonafied voter who was refused was carrying the voter ID card.
Repolling was ordered for the booth today and the accused were produced before justice Mr Aninda Bhattacharya who allowed bail. The CPI-ML candidate, Mr Sailen Bhattacharya alleged that the PPs with the Asansol court had expedited the bail process after the state law minister, Mr Nishit Adhikari himself intervened. The CPI-M however refused to accept the charge. The repolling in the said booth meanwhile passed off peacefully today. The ADM, Asansol, Mr NS Nigam said, '53 percent voting was recorded today and there was no untoward incident.' Besides the election observer, the DM, the ADM themselves were present in Churulia. In another booth in Monteswar in Katwa segment 60 percent polling was recorded. Repolling was ordered after the EVM went out of order in the booth number 90 in Monteswar on the day of general election.
